At approximately 5:12 pm, on April 4, TFC R. Lemerise initiated a traffic stop for speeding, 64 mph in a posted 55 mph zone on southbound Route 301, north of Mt. Air Road.
TFC Lemerise made contact with the operator, identified as Louis Joseph Flanagan, 32 years, of Colonial Beach, Virginia, who’s eyes were red, glassy and his speech slurred.
TFC smelled a strong odor of alcoholic beverage on Flanagan’s breath. When asked if he had consumed any alcohol, Flanagan stated “two beers and a shot.” TFC Lemerise had Flanagan perform the standardized field sobriety test, which he did not pass.
Flanagan was placed under arrest. A search incident to arrest revealed a small wooden box located in the driver’s side door pocket. The box contained marijuana with a metal cigarette with burnt residue.
Flanagan was transported to the Maryland State Police Barrack for initial processing, then transported to the Charles County Dentention Center pending bond review.
Flanagan was charged with the following: did possess a controlled dangerous substance of schedule I, to wit: marijuana; did possess with intent to use drug paraphernalia, to wit: one wooden box, used to store/contain a controlled dangerous substance of Schedule I, to wit: marijuana; and DUI.
