At approximately 4:26 am on April 15,ย Tpr. R. Garrett was traveling eastbound on Maryland Route 228, observing oncoming traffic traveling westbound on Route 228.ย 

Tpr. Garret was operating radar when he observed a vehicle enter the radar beam that appeared to be going well above the posted limit of 50 mph.ย  The vehicle entered at 82 mph.ย 

Tpr. Garrett activated his emergency equipment and initiated a stop on a white Cadillac Seville bearing MD registration 3CHX10 as it turned onto Greenmount Drive, north of Route 228.ย  Tpr. Garrett made contact with the driver, and detected an odor of an alcoholic beverage.ย  Field Sobriety was conducted and the driver was placed under arrest for DUI.ย 

During a search incident to arrest, two passengers were removed separately from one another.ย  Burke began reaching into his pockets near the rear of the vehicle.ย  Tpr. Garrett observed on clear plastic baggie on the ground near him.ย 

When Tpr. Garrett asked the driver to identify himself, the driver became defensive and refused to provide any information, stating that he wanted an attorney.ย  The driver continued refusal as to his identity for the duration and had to be positively identified at the Charles County Detention Center.ย 

He was identified as Jason Daniel Burke, 22 years of Waldorf.ย  Burke had an open warrant through the Circuit Court of St. Maryโ€™s County, as well as an open Criminal Summons, through Charles County.ย  Burke was charged with the following:ย  possession of marijuana and possession of CDS paraphernalia.
