
Prince Frederick, MDโ On March 19, Maryland State Police Tfc. T. Newcomer responded to the Green Turtle located at Solomons Island Road in Prince Frederick for a fight in progress.
When Newcomer arrived on the scene, he observed a large crowd of people outside of the Green Turtle and in the parking lot. Newcomer also observed Sgt. Payne of the Maryland State Police ask two individuals to leave the premises of the Green Turtle.
The first male was identified as James Patrick Kempf Jr., 26 of Huntingtown and the second male was later identified as Brian Jerome Heying, 26 of Chesapeake Beach. According to charging documents, โHeying was attempting to get Kempf to leave by pulling him by his shirt. However, Kempf did not comply. I (Newcomer) told Kempf to leave for the second time, and he stated, โIโm going Toddโ but did not leave.โ
After approximately thirty seconds Kempf began walking towards the entrance of the Green Turtle again, I stopped him and told him that he has to leave. Kempf stated, โMy cousin got in a fight, and kept walking towards the Green Turtle. I (Newcomer) stopped Kempf, and once again Heying attempted to get Kempf to leave the premises. Kempf did not comply and shouted, โ(Expletive) you, what are you going to arrest me?โ causing several patrons outside of the Green Turtle to avert their attention to Kempf,โ according to charging documents.
Kempf was placed under arrest for trespassing, disorderly conduct, and failure to obey a lawful order. Kempf was transported to the Calvert County Detention Center to await the appearance before a Calvert County District Court Commissioner.
According to charging documents, โwhile at Calvert County Detention Center Kempf was offered a preliminary breath test which indicated a BrAC of .30.โ Kempf at this time does not have a scheduled court date.ย ย
