Baltimore, MD – Several Baltimore City media outlets have confirmed that the two New York State men charged with assaulting a Ravens fan at the NFL team’s stadium in early Oct. have been indicted. Baltimore City State’s Attorney’s Office reported Scott Smith, 30, of Mount Vernon, N.Y/; and Andrew Nappi, 31, of Eastchester, N.Y., were both indicted Thursday, Oct. 27 on charges of conspiracy to commit assault and reckless endangerment.

The case has now been transferred from District Court to Baltimore City Circuit Court. No court dates for Smith and Nappi have been determined.

The victim, Joseph Bauer, 55, of Jessup, remains under medical care at the University of Maryland Rehabilitation and Orthopedic Institute. According to police reports cited by media sources, including the Baltimore Sun, during the confrontation at M and T Bank Stadium Oct. 2, Bauer was punched in the head, pushed to the ground, hit his head on the ground and was knocked unconscious. Nappi claims during the scuffle Bauer threw a bottle, hitting Smith in the head. An attorney for Smith has been quoted by Baltimore’s WJZ-TV as stating “a vastly different version of the story” is being found out through an investigation the defense lawyer is conducting.
