LA PLATA, Md. — A dispute over the proposed 183-lot Falcon Ridge subdivision near Indian Head will return to the Charles County Board of Appeals in September.
The board voted unanimously Tuesday, July 14, to continue Docket No. 1489 until Sept. 22.
Falcon Ridge is a proposed 183-lot subdivision on approximately 117.30 acres off Mason Springs Road, or MD Route 425, near Henry E. Lackey High School in Indian Head. The property includes Tax Map 21, Grid 7, Parcels 38 and 219 and is zoned Watershed Conservation District.
According to a Charles County Planning Commission staff report presented Nov. 4, 2024, Falcon Ridge was initially approved in February 1999 for 184 single-family lots. The preliminary subdivision plan was later revised, with the current 183-lot version receiving administrative approval in March 2018.
County records show 33 lots, or about 18% of the project, have been recorded. The developer was seeking additional time to reach the 25% threshold, which would equal about 46 recorded lots.
White Oak LLC is appealing a March 23 decision by the Charles County Planning Commission denying another six-month extension for the project. The requested extension would have moved the plan’s expiration from April 17 to Oct. 17.
According to exhibits filed in the Falcon Ridge Board of Appeals case, the project has received multiple extensions over the years. The developer’s latest request for another six months was denied and is now under appeal.
White Oak estimated that stopping the project could result in about $3.03 million in lost water and sewer connection fees for Charles County. The developer also estimated that the neighboring Hunters Brooke community could lose future homeowners association contributions from 150 homes. The figures were provided by the applicant and have not been independently verified by The BayNet.
The continuance was requested because the developer’s lead consultant and primary witness is recovering from a broken foot and cataract surgeries. White Oak said it could not present its appeal without him.
