On December 29, 2010 at approximately 9:20 p.m., members of the Calvert County Sheriffโ€™s Office Patrol Bureau and Crash Reconstruction Team responded to Gunsmoke Trail and Long Bow Court in Lusby, for a report of a motor vehicle collision involving a Calvert County Sheriffโ€™s Office cruiser and a pedestrian. ย 

Preliminary investigation revealed the following:

A Deputy Sheriff was operating in his Calvert County Sheriffโ€™s Office marked patrol cruiser and was in an on-duty status. The Deputy was traveling south on Gunsmoke Trail when his vehicle struck the pedestrian, who was walking south on Gunsmoke Trail on the south bound white line of Gunsmoke Trail. ย 

The pedestrian was identified as Daniel Jack Borgholthaus, 25 year old male, resident of Lusby. ย The Deputy immediately stopped his vehicle and rendered aid to Borgholthaus until EMS crews arrived on the scene. ย Borgholthaus was transported to Calvert Memorial Hospital to be treated for minor injuries to his lower extremities. ย At the time of the collision Borgholthaus was wearing dark clothing and walking on the right side of the travel portion of the roadway (with traffic) in an unlit area of Gunsmoke Trail. ย Due to his position in the roadway, color of his outer garments and the absence of retro reflective material on all of his clothing Borgholthaus could not be seen by motorists traveling south on Gunsmoke Trail. ย As a result of the investigation Daniel Jack Borgholthaus was issued a Maryland Uniform Traffic Citation charging him with a violation of the MD Transportation Article ยง21-506 (b) Pedestrian Failure to Walk on Left Shoulder and Left Side of Roadway When Sidewalk Not Provided.
