Leonardtown, MD — A Callaway man has been sentenced to 10 years in jail after pleading guilty to second-degree burglary. Damian Walker, 42, was sentenced Oct. 5 by St. Maryโ€™s County Circuit Court by Judge Michael Stamm. However, as the result of a plea bargain, Walker will be eligible to have the remainder of his sentence suspended after serving three years if he does well in rehabilitation.

Judge Stamm recommended that Walker be sentenced to Patuxent Institute, the state penal facility known for its counseling and rehabilitation work. Walkerโ€™s attorney, public defender Edie Fortuna Cimino, said her client has not had the opportunity for drug treatment up to this point. How well he does in treatment will be a consideration by the judge in a reconsideration of Walkerโ€™s sentence.

Walker was charged in connection with a break-in of Bobโ€™s Sunoco in Callaway on Jan. 30 of this year. A large amount of cigarettes were stolen. Walker was arrested by deputies from the St. Maryโ€™s County Sheriffโ€™s Office after a surveillance video captured his likeness and a partial tag number of the vehicle involved. When Walker was arrested the cigarettes were found in his car.

According to Deputy Stateโ€™s Attorney Joe Stanalonis, the victim went along with the plea agreement. โ€œYou can be happy that the victim wants this to happen,โ€ Judge Stamm said.

Walker has been in jail since January after his arrest and was given credit for the time he has already served. He will be on three yearโ€™s supervised probation once he is released.
