Prince Frederick, MD โ€“ The criminal jury trial of a Calvert County woman charged in the deaths of a couple killed in a biking accident last October is being moved to the summer.

The defendant, identified in police and court records as Catherine Frances Lyon, 62 of Huntingtown, is currently free on $200,000 bond. Lyon was indicted late last year on eight felony charges. The indictment includes two counts each of negligent manslaughter and homicide with a motor vehicle while impaired by alcohol, and four counts of negligent homicide while under the influence. She also faces two counts of driving under the influence and one count of driving while impaired.

The charges stem from an incident that occurred Saturday, Oct. 31 on Tobacco Road near Chesapeake Beach. A coupleโ€”identified as John Henrik Fauerby, 64 and Lynne Frances Rosenbusch, 58, both of Clarksburgโ€”were traveling on a tandem. Around 3 p.m. the cycle was rear-ended by a motor vehicle. Fauerby and Rosenbusch were both ejected from the cycle. Both died a short time later.

According to court documents, Lyon, who was driving 2014 Jeep Cherokee, was at the scene when police arrived. She initially told officers that she had stopped to check on the injured cyclists. However, police observed damage to the Jeep and detected alcohol on Lyonโ€™s breath. She admitted she had been drinking before the incident.

When administered a breath test, Lyon blew a .12 BrAC.

On Monday, Feb. 1 Lyon and her attorney, Joseph Carey of Bowie, were in Calvert County Circuit Court for a hearing presided over by Judge Marjorie Clagett. Lyonโ€™s trial was originally scheduled for early May. However, Carey told Clagett he had a conflict with the date due to a pending family matter. He and the prosecuting attorney, Calvert County Assistant Stateโ€™s Attorney Andrew Rappaport, had agreed the trial could be moved to July 11 through 15 or June 27 through July 5. The rescheduling required Lyonโ€™s consent to hold the trial beyond the legal 180-day period. Lyon agreed to sign the waiver.

Clagett will rule Wednesday, Feb. 3 on a new trial schedule.
