CHARLOTTE HALL, Md. — An Olney man previously barred from a Charlotte Hall grocery store was arrested after allegedly returning to the business and consuming food without paying.
Devin Isaiah Herford, 25, of Olney, Maryland, was charged with theft of less than $100 and trespassing on private property.
According to charging documents, a St. Mary’s County sheriff’s deputy responded to the Weis Market at 29989 Three Notch Road on Aug. 2 for a reported trespassing complaint.
A store manager told the deputy that Herford was inside the store speaking with an employee.
The deputy confirmed through emergency communications that Herford had previously been issued a notice not to trespass at that Weis Market location. Herford was escorted outside, issued a criminal citation for trespassing and told he would be arrested if he returned.
Police said Herford left the property but returned later that evening.
At approximately 6:56 p.m., emergency communications notified the deputy that Herford was again inside the store. He was escorted outside and placed under arrest for trespassing.
During a search following the arrest, the deputy allegedly found a bottle of hand sanitizer tucked into Herford’s waistband. Herford reportedly said he had purchased it from the store.
An employee told police that Herford had not purchased anything.
The store manager alleged that Herford walked through the business with two chicken sandwiches and a bag of mixed nuts and berries, consumed the items inside the store and did not pay.
Charging documents state that the sandwich wrappers were found in a restroom, with one sandwich eaten and the other partially eaten. The bag of mixed nuts and berries was reportedly open and empty.
The two sandwiches were valued at $14 total, while the bag of mixed berries was valued at $5.
Herford was transported to the St. Mary’s County Detention and Rehabilitation Center.
He was released Aug. 3 on a $1,500 unsecured personal bond.
A trial is set for Sept. 21 at 1 p.m. in St. Mary’s District Court.
