
LEXINGTON PARK, Md. — A Lexington Park man arrested on an outstanding warrant is now accused of trying to ditch suspected K2 beneath a patrol vehicle after a deputy told him several times to stop reaching into his pockets, according to charging documents.
Patrick Henry Nutter, 40, of Lexington Park, was charged with altering physical evidence in a criminal proceeding, possession of a controlled dangerous substance other than cannabis, and possession of CDS paraphernalia.
A deputy located Nutter on May 6, 2026, in the area of FDR Boulevard and South Shangri La Drive in Lexington Park. The deputy wrote that he knew Nutter from prior police encounters and knew he had an outstanding warrant for his arrest.
After confirming the warrant, the deputy placed Nutter in handcuffs and told him not to reach into his pockets because he was making multiple attempts to do so, the charging documents state.
While retrieving rubber gloves from the passenger side of the patrol vehicle to conduct a search incident to arrest, the deputy said he saw Nutter turn around and again appear to reach into his jacket pockets.
When questioned, Nutter allegedly claimed he was trying to remove trash. Police said a small graphic Ziploc-style bag containing a green leafy substance was then found on the roadway beneath Nutter and partially under the patrol vehicle.
The deputy identified the substance as suspected K2, a synthetic cannabinoid. Police alleged Nutter removed the bag from his person and dropped it on the ground because he knew it would be discovered and could be used against him in future court proceedings.
The deputy also noted that Nutter had an empty soda can on him that had not been thrown on the ground, which police cited as part of the reason they did not believe he was simply removing trash.
Nutter was arrested and transported to the St. Mary’s County Detention Center. Court records show he was given a $1,000 unsecured personal bond that same day.
A hearing is set for June 11, 2026, at St. Mary’s District Court.
Under Maryland law, the charges carry a combined maximum penalty of up to four years of incarceration and up to $10,500 in fines if Nutter is convicted and sentenced to the maximum consecutive terms.
