Two class action lawsuits have been filed in U.S. District Court against the maker of the popular Stanley cups. Customers are suing because the company didn’t disclose that their products contain lead.

The lawsuits comes weeks after Stanley confirmed that the sealing material they use at the base of their cups does contain “some lead.”

The company released a statement saying, “No lead is present on the surface of any Stanley product that comes into contact with the consumer nor the contents of the product.”

The issue came to light when consumers started performing at-home lead tests on their tumblers and posting the results on social media. Some results varied and there have been no reports of the cups causing any health issues.

The lawsuits were filed by two women, one in California, and one in Nevada. The women allege the company didn’t warn purchasers of the potential presence of lead, claiming it violated their right to make an informed decision about whether or not to buy the cup.

USA Today reported on a statement made by Stanley saying they will “vigorously defend itself against meritless claims.”

The women are seeking monetary compensation, for Stanley to update their advertising campaign and issue a product recall, and for Stanley to be banned from selling the cups until lead levels are removed or fully disclosed.
