LUSBY, Md. — A Lusby man was arrested after deputies and firefighters responded to multiple reports of an intoxicated man lying in or near the roadway along Rousby Hall Road, where authorities later said he spit toward a deputy during the investigation.

Michael Sean Marshall, 40, of Lusby, is charged with second-degree assault, disorderly conduct and intoxicated public disturbance.

The Calvert County Control Center received multiple calls for service on May 29, 2026, for an unresponsive subject in the area of Rousby Hall Road and H.G. Trueman Road in Lusby, charging documents state.

The first caller reported that a white male who was not wearing shoes was lying in the roadway, appeared impaired and was yelling. A second caller reported the man was on Rousby Hall Road near Buckets Sports Bar, approaching occupied vehicles and lying down in the roadway while heavy traffic passed by.

A third caller reported the man was farther south on Rousby Hall Road near Southern Connector Boulevard and appeared to be injured, according to court documents.

As deputies responded, Engine 31 from the Solomons Volunteer Fire Department reported they were with the subject in the area of 12065 Rousby Hall Road. A Calvert County Sheriff’s Office deputy arrived and identified the man as Marshall.

Marshall was lying on his back just off the roadway with his arm covering his face, according to charging documents. Members of Engine 31 attempted to wake him by performing several sternum rubs, which eventually caused him to become responsive.

The deputy reported that Marshall appeared extremely intoxicated. A black plastic bag and an open can of alcohol were also seen lying near his head, according to court documents.

EMS personnel attempted to speak with Marshall, but he repeatedly interrupted them and said he only wanted to hear from deputies. When a deputy asked whether he needed medical assistance for any injuries, Marshall allegedly turned his head and spit toward another deputy’s feet and legs.

Marshall was assisted to his feet, told he was under arrest and placed in handcuffs. During a search incident to arrest, the deputy reported finding an empty Fireball shooter in Marshall’s left cargo pocket.

The deputy also reported that multiple residents from nearby homes were outside watching the incident while Marshall continued yelling.

Marshall was transported to the Calvert County Detention Center. Court records show he was released May 30, 2026, on a $2,500 unsecured personal bond.

A trial is set for July 29, 2026, in Calvert District Court.
