James Edison Smith Jr.
Prince Frederick, MD – A Calvert County couple was indicted in January in connection with the sexual abuse of a minor, documents on file in circuit court stated. The couple is identified by the court as James Edison Smith Jr., 33 and Michelle Fountain Smith, 30, both of Prince Frederick.
The victim is identified in the indictment as a female “under the age of 14 years.” The alleged abuse occurred between Jan. 1, 2014 and Sept. 30, 2015.
James Smith was indicted on one count each of sexual abuse of a minor and sex abuse of minor, continuing course of action. Both charges are felonies.
Michelle Smith was charged with a single count of neglect of a minor. Under that count, state prosecutors contend the neglect occurred between Dec. 15, 2015 and Jan. 13, 2016.
Both James and Michelle Smith were indicted on one count of contribution to acts, omissions or conditions rendering a child in need of assistance.
According to court documents, James Smith is currently incarcerated in the Calvert County Detention Center. He has a pre-trial hearing scheduled for March 7 and is being represented by Luis F. Gomez Jr. of Rockville.
Michelle Smith is scheduled to appear before a circuit court judge Monday, Feb. 8.
